Terms of Service

1. Scope and Applicability

Hirejin ("Hirejin", "we", "us", or "our") provides an AI-assisted resume parsing, analysis, and scoring platform (the "Platform") that helps users upload resumes and job descriptions, review extracted information, and generate criteria-based rankings and tables (the "Services"). These Terms of Service ("Terms") govern your access to and use of the Platform and Services.

By accessing or using the Platform, you agree to be bound by these Terms and any additional agreements or policies referenced here, including our Privacy Policy and, where applicable, a separate order form or master services agreement (each an "Order"). If there is a conflict between an Order and these Terms, the Order controls for the conflicting subject matter.

2. Services

Hirejin provides access to the Platform on a software-as-a-service basis. The Platform may include features such as resume and document upload, parsing, text extraction, analysis, semantic matching, scoring against configurable criteria, shortlisting, and results export. We may improve, modify, or discontinue features from time to time. Substantial adverse changes to materially paid features will be communicated in advance when reasonably practicable.

Some functionality may rely on third-party infrastructure or AI model providers. Output quality and availability can be affected by those providers. We process only the data available to us and may adjust functionality based on changes in those sources or providers.

3. Your Obligations

• Lawful basis and permissions: You are responsible for ensuring you have a lawful basis to process any personal data that you upload to the Platform (e.g., consent, legitimate interest), and that you have provided any notices required by applicable law.
• Accuracy and updates: You must provide accurate account information and keep it current. Promptly report Platform issues with sufficient detail to facilitate resolution.
• Account security: Keep your credentials confidential and use strong passwords. You are responsible for actions taken using your account unless you have notified us of suspected compromise without undue delay.
• Backups: Maintain appropriate backups of your own data. The Platform is not a data archival service.
• Compliance and fair use: You agree not to use scoring or filtering in a way that violates employment, anti-discrimination, or equal opportunity laws. Do not configure criteria based on protected attributes or proxies for protected attributes. You are responsible for complying with applicable data protection regulations like GDPR and CCPA.

4. Data Access and Rights

You grant Hirejin the non-exclusive right to process, host, and use the data you upload ("Your Data") solely to provide the Services and improve functionality in aggregated and anonymized form. You represent that Your Data does not violate applicable law or third-party rights. We may suspend access where Your Data appears unlawful or infringes third-party rights.

5. Availability and Maintenance

We aim for high availability (targeting 99% annually, excluding planned maintenance and events outside our reasonable control). We may restrict access for maintenance, security, or operational reasons and will provide advance notice of material downtime when feasible. Support requests will be responded to within a reasonable timeframe, though delays due to third-party services or unforeseen events are outside our control.

6. Term and Termination

Unless otherwise specified in an Order, subscriptions renew automatically for successive terms of equal length unless cancelled prior to the renewal date. Either party may terminate for material breach if not cured within thirty (30) days after written notice. Upon termination or expiry, we are not obligated to retain Your Data beyond any retention period stated in an Order or our policies.

7. Fees and Payment

You agree to pay fees as set forth in an Order or our then-current price list, except for features clearly designated as free. We may issue electronic invoices. Unless otherwise stated, payments are due within seven (7) days of invoice date. Late amounts may accrue statutory interest and we may suspend the Services for overdue accounts after notice.

8. Refund Terms

We offer a 14-day refund window for unused credits on paid plans. Refunds are only available within fourteen (14) days of purchase and only if the credits remain completely unused. Once any credits are consumed (e.g., for parsing or scoring), refunds are not available due to AI processing costs. By creating an account and purchasing credits, you accept these refund terms. We are not liable for any consequential or indirect damages arising from disputes related to refunds or unused credits.

9. Intellectual Property; License

As between the parties, Hirejin and its licensors own all rights in the Platform and Services. Subject to timely payment of applicable fees, we grant you a limited, revocable, non-exclusive, non-transferable, and non-sublicensable license to access and use the Platform solely for your internal recruiting purposes, in accordance with these Terms and documentation.

10. Warranty and Disclaimers

We provide the Services in a professional manner and use commercially reasonable efforts to keep them free of material defects. AI outputs, suggestions, rankings, and scores are generated probabilistically and may be inaccurate or incomplete. You are solely responsible for reviewing results, making hiring decisions, and ensuring compliance with applicable laws and policies. AI-generated outputs are intended to assist and not replace human judgment. To the maximum extent permitted by law, the Services are provided “as is” and “as available”.

11. Limitation of Liability

To the extent permitted by law, Hirejin’s liability for paid Services is limited to damages that are foreseeable and arise from a breach of essential contractual obligations; in all other cases we are not liable for slight negligence. For free Services, we are only liable for intent or gross negligence. These limitations apply to our employees and agents to the same extent.

12. Confidentiality

Each party will protect the other party’s non-public information with reasonable care and use it only for purposes of the Services. We may use aggregated and anonymized data to improve the Services, provided it does not identify you or your candidates.

13. Data Protection

We process personal data as described in our Privacy Policy and, where applicable, under a data processing agreement. We implement appropriate technical and organizational safeguards to protect personal data against unauthorized access, alteration, or disclosure. You are responsible for obtaining required permissions and ensuring compliance with all applicable data protection laws, including but not limited to GDPR, CCPA, or similar regulations.

14. Prohibited Content and Usage

14.1 Illegal or Infringing Content

• Content that violates laws or third-party rights, including IP rights and privacy rights.
• Uploading resumes or documents without proper authorization or consent.

14.2 Discrimination and Sensitive Attributes

• Criteria or filtering based on protected characteristics (e.g., race, color, religion, national origin, sex, gender identity, sexual orientation, disability, age, or any other protected class) or proxies for such attributes.
• Use of the Platform to make unlawful automated decisions without required human review.

14.3 Harmful, Deceptive, or Misleading Use

• Misrepresenting AI-generated scores as definitive or error-free.
• Attempting to re-identify anonymized data or circumvent security controls.
• Attempting to reverse engineer, probe for vulnerabilities, or disrupt the Platform’s services.

15. Third-Party Services

The Services may interoperate with third-party tools (e.g., cloud storage, ATS integrations, AI model providers). Your use of third-party services is subject to their terms, and we are not responsible for third-party services.

16. Changes to these Terms

We may modify these Terms by providing notice (e.g., via the Platform or email). Material changes will be communicated in advance when practicable. Your continued use after the effective date constitutes acceptance of the updated Terms.

17. Final Provisions

These Terms are governed by the laws of India, excluding conflict of law rules. The exclusive jurisdiction and venue for disputes is the courts located in Delhi, India. If any provision is held invalid or unenforceable, it will be replaced by a valid term that best reflects the parties’ intent, and the remaining provisions will remain in full force. Amendments and waivers must be in writing, which may include electronic signatures.
